Terms of Service

These Terms of Service (“Terms”) apply to all services provided by Consult ITfy (“we”, “our”, “us”). By purchasing or using our services, you (“the client”, “you”) agree to the following:

1. Services

Consult ITfy provides AI automation solutions including, but not limited to:

  • Chatbots

  • Email automation

  • Document summarizer

  • Lead capture and processing automation

  • Appointment workflow automation

Services are customised based on information and access provided by the client.

2. Client Responsibilities

To ensure successful delivery, you agree to:

  • Provide accurate requirements, project details, and communication

  • Supply necessary access credentials (e.g., API keys, platform access)

  • Ensure you have rights to integrate with all requested systems

  • Review all deliverables before use in production or business-critical workflow

If required access or information is delayed, delivery dates may be extended.

3. Delivery and Acceptance

Delivery timelines depend on the selected package and timely client input.
A project is considered delivered once the agreed scope is completed.

Small adjustments may be provided within the agreed revision limit.

4. Intellectual Property

Upon full payment:

  • You may use the delivered automation inside your business

  • We retain the right to showcase non-confidential project elements in our portfolio unless otherwise agreed in writing

Third-party components (OpenAI, n8n, Zapier, etc.) remain subject to their respective licenses.

5. Payments and Refunds

Payments must be made in full prior to commencement unless otherwise agreed.

Refunds follow our Refund & Cancellation Policy.

6. Use of AI and Automation Outputs

AI-generated content may vary in performance and accuracy.

You are responsible for:

  • Reviewing all outputs before relying on them

  • Monitoring performance after deployment

  • Determining suitability for your business use

Our tools assist business operations — they do not replace human judgment.

7. Limitation of Liability

To the maximum extent permitted by law:

  • Consult ITfy is not liable for any:

    • Indirect, incidental, special, or consequential loss

    • Economic loss or lost profits

    • Business interruptions or reputational damage

  • We are not responsible for failures caused by:

    • External platforms (e.g., API changes, server outages)

    • User error, misuse, or unauthorised modifications of workflows

    • Third-party data, integrations, or content provided by clients

  • Our total liability for any claim is limited to the total amount paid for the specific service in question.

Nothing in these Terms excludes any rights or guarantees you have under the Australian Consumer Law (ACL).

8. External Dependencies (Force Majeure)

Our services rely on third-party systems. We cannot guarantee:

  • Uptime or availability

  • Response quality from AI models

  • Continuity if vendors change services or pricing

We will make reasonable efforts to adapt workflows if changes occur.

9. Confidentiality

We will treat your confidential business information with care and discretion.
We may anonymise and reference workflow design patterns for learning and general marketing unless requested otherwise.

10. Jurisdiction

These Terms are governed by the laws of New South Wales, Australia.
Any disputes shall be resolved in NSW courts.
